When using the Website, you agree not to:
- Use the Website in any way that breaches any applicable law or regulation (including the Laws of Kenya);
- Copy, republish, upload, transmit or redistribute Website content for any commercial purpose without our prior written consent;
- Attempt to gain unauthorised access to any part of the Website, its servers, databases, admin areas or any connected systems ("hacking");

5. Intellectual Property Rights
All content on the Website — including the SPN logo, name, photographs, videos, school magazine, newsletters, prospectus, documents, design, code, text, graphics and their arrangement — is the property of St. Philip Neri Primary and Junior School or its licensors and is protected by copyright, trademark and other intellectual property laws.
- You may not use, reproduce, adapt, modify or distribute our content or materials except as expressly permitted in these Terms;
- The SPN name, logo and branding may not be used in any commercial or public context without prior written permission from the School;
- Downloading a document (for example, a newsletter or the school profile) grants you a personal, non-transferable licence to view and print it for school-related purposes only. Re-uploading, selling or claiming authorship of our documents is prohibited;
- Third-party trademarks and content appearing on the Website (including embedded YouTube videos and social-media content) remain the property of their respective owners.
6. Admissions and Enrolment
Information on the Website about admissions, interviews, entry assessments and vacancies is provided for convenience and does not of itself constitute an offer of admission or entry into any agreement.
- An admitted place is confirmed only through the School's official admission process — completed enrolment forms, an official fee receipt and written communication from the School's administration;
- Submission of an application form (online or offline) does not guarantee admission. Offers are subject to availability, assessment results and the School's admission criteria as published on the Admissions page;
- The School reserves the right to decline applications and to adjust class sizes, entry requirements and admission dates;
- Provisional or confirmed admission may be withdrawn if information supplied during enrolment is found to be false or material fees remain unpaid.
7. Fees and Payments
Fee information published on the Website (including the Fees page and any downloadable fee structure) is provided for guidance and is subject to change without prior notice, except where written notice is expressly given to parents or guardians.
- Only payments made through the School's official bank accounts and payment channels — as confirmed by the School administration — constitute valid payment of fees;
- The School is not responsible for fees paid to unverified accounts or impersonation scams. Always verify payment details through our official phone numbers (0711 999 111 | 0719 221 401) before transferring money;
- Payment terms, deadlines, and consequences of late payment are governed by the enrolment agreement and the Payment Terms published on the Fees and Admissions pages;
- Refunds, where applicable, are processed in accordance with the School's financial procedures and applicable Kenyan law.
8. Downloadable Documents
Documents made available for download on the Website — including term newsletters, the school magazine, the school profile and prospectus — are subject to the following:
- Earlier versions may remain accessible; in any conflict, the most recent version published on the Website is authoritative;
- Contents reflect the School's information at the time of publication and may change thereafter;
- Documents must not be altered, re-uploaded or redistributed commercially (see Section 5);
- We do not guarantee that download files will always be available, uninterrupted or free from technical error.
9. Newsletter Subscriptions
By subscribing to the SPN newsletter through the Website, you:
- Consent to the School sending you school news, event invitations, notices and related communications to the email address you provide;
- Confirm that the email address you provide is yours or one you are authorised to use;
- May unsubscribe or withdraw consent at any time by replying to our emails with an unsubscribe request or by contacting info@stphilipnerischool.sc.ke.
Subscriptions are voluntary. We will not share your email address with third parties for their own marketing purposes (see our Privacy Policy).
10. Forms and Information You Submit
You are responsible for the accuracy and legality of information submitted through any form on the Website. Do not submit information about another person (for example, a student) unless you are their parent or guardian or are authorised to do so.
11. Third-Party Links and Embedded Content
The Website may contain links to third-party websites and embedded third-party content, including YouTube videos, WhatsApp links and social-media pages. These are provided for convenience only.
- We do not control and are not responsible for third-party websites, their content, or their own privacy practices;
- Embedded videos and social content may set their own cookies or collect data once you interact with them — see our Cookie Policy;
- Links to external sites do not imply endorsement by the School;
- You access third-party sites at your own risk and are subject to their terms.
12. Accuracy of Information
We work hard to keep the Website accurate and up to date, but we do not warrant that the Website or its content is complete, accurate, current or error-free at all times. School terms dates, events, activities, facilities, staff arrangements, programmes and fees may change without notice. Event listings, news articles and blog posts reflect information current at the time of publication.
13. Availability of the Website
The Website is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free access; the Website may be temporarily unavailable for maintenance, upgrades or reasons beyond our control. We may suspend, withdraw or restructure any part of the Website at any time.
14. Limitation of Liability
To the maximum extent permitted by law:
- The School shall not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of (or inability to use) the Website;
- The School shall not be liable for any loss of data, profits, revenue, business or opportunity, nor for any loss or damage arising from reliance on the Website's content;
- Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability arising from negligence where it cannot be limited under Kenyan law;
- If any element of the above limitation is found unenforceable, the liability of the School will, in any event, be limited to the maximum extent permitted by law.
15. Privacy and Cookies
Your privacy and your use of cookies on the Website are governed by our Privacy Policy and Cookie Policy. These policies form part of these Terms.
16. Photographs and Publicity
Images, videos and student work published on the Website are shared under the consent framework described in our Privacy Policy (Audio-Visual Consent Form). If you are a parent or guardian and you wish to raise any concern about a specific image or video, contact the School administration and we will review and, where appropriate, remove it.
17. Termination of Access
We may terminate or restrict your access to all or part of the Website, without notice and without liability, if in our reasonable opinion you have breached these Terms or we are required to do so by law or by a competent authority.
18. Severability and Entire Agreement
If any provision of these Terms is found invalid, unlawful or unenforceable, that provision will be severed and the remaining provisions will remain in full force. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and the School relating to your use of the Website.
19. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any dispute arising out of or relating to the Website or these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
20. Changes to These Terms
We may update these Terms from time to time to reflect changes in the Website, the School, or the law. The latest version will always be posted on this page with an updated "Last updated" date. Continued use of the Website after changes become effective constitutes acceptance of the updated Terms.
